What is a postnuptial agreement?

It is a contract between two people who are already married. It says how they would divide assets, handle debts and deal with maintenance if the marriage ends.

A prenuptial agreement is signed before the wedding. A postnuptial agreement is signed during the marriage.

Couples often make one after a big financial change, such as an inheritance or a successful business. Some use it to settle money disputes without ending the marriage.

Does Malaysian law recognise them?

The Law Reform (Marriage and Divorce) Act 1976 does not specifically deal with postnuptial agreements. No law expressly makes them valid or invalid. The court may treat one as a factor when deciding on assets and maintenance.

The Contracts Act 1950 sets the general rules for contracts, including offer, acceptance, consideration (something of value given in return) and free consent. An agreement that meets these rules stands on firmer ground.

How is it different from a prenuptial agreement?

Legally, the two are treated much the same. Both can persuade the court but do not bind it. Under Section 76, the court still divides matrimonial assets as it finds just.

One practical difference: a postnuptial agreement deals with assets and debts you already have. It is based on real facts, not guesses about the future, so the court may find it more relevant.

But the court may also ask whether it was signed under pressure. If one spouse threatened to leave unless the other signed, free consent is in doubt.

What should it cover?

  • which assets each of you owns alone and which you own together
  • how those assets would be divided on divorce
  • whether one of you would pay maintenance, and how much or how it is worked out
  • who is responsible for which debts

Terms about child custody or child maintenance carry little weight. The court decides these on the child’s best interests, whatever the parents agreed.

What makes it more persuasive?

  • Each of you gets advice from your own separate lawyer.
  • Both of you disclose your finances fully and honestly.
  • Both of you sign freely, without pressure.
  • It is signed during a calm period, not in the middle of a crisis.
  • The outcome is fair to both sides, not heavily one-sided.

Can it override the court?

No. Section 76 gives the court power to divide matrimonial assets as it considers just. The agreement is evidence of what you both intended, but the judge decides.

If the result would be grossly unfair, the court will depart from it. For example, if a spouse who contributed a lot to the marriage would be left with nothing, the court is likely to order a different split.

Is it worth having one?

It can be. It sets out each person’s expectations, gives a starting point for negotiation if you divorce, and shows the court what you both intended.

It is most useful where one spouse has significant assets, runs a business or expects an inheritance. It does not remove the court’s power, but it is better than having nothing in writing. Have it drafted by a family lawyer who understands its limits.

Frequently asked questions

What is a postnuptial agreement?
It is a contract made between spouses after the wedding. It sets out how assets, debts and maintenance would be handled if they divorce.
Are postnuptial agreements treated differently from prenuptial agreements in Malaysia?
Not much. Neither is specifically dealt with in the Act, and the court can still divide assets as it thinks fair in both cases.
Can a postnuptial agreement decide child custody?
No. Custody terms in the agreement do not bind the court. It always decides custody on the child's welfare under Section 88.
