What is a prenuptial agreement?

A prenup is a contract between two people who plan to marry. It sets out how assets and debts will be divided if the marriage ends. In many countries it is binding, but not in Malaysia.

The Law Reform (Marriage and Divorce) Act 1976 does not mention prenups at all. Under Section 76, the court decides how to divide matrimonial property, and a prenup is only one thing it may consider.

How do Malaysian courts treat prenups?

Courts have not consistently enforced prenups as binding contracts. The court keeps its power under Section 76 to divide assets in the way it considers fair, and a prenup cannot override that.

A prenup can still be useful evidence of what you both intended when you married. The court is more likely to give it weight if you both signed freely, each had independent legal advice and made full financial disclosure.

What makes a prenup more persuasive?

  • Each of you had independent legal advice before signing.
  • Each of you fully disclosed assets and debts at the time.
  • The terms are fair. A prenup that leaves one spouse with nothing is unlikely to carry weight.
  • It is in writing, properly signed and, ideally, notarised. The law does not strictly require these steps, but they add credibility.

The court may ask whether the terms were fair when you signed and whether they are still fair at the time of divorce.

What are the alternatives?

A postnuptial agreement, made after the wedding, has the same limits. It can still show what you both intended.

You can also keep clear records of what you owned when you married. Bank statements, property valuations and share certificates dated before the marriage help the court see which assets were yours beforehand and may be left out of the division.

Yes. Whether you are thinking about a prenup or already have one, a family lawyer can tell you how much weight it is likely to carry. If you want to protect particular assets, get advice early so the agreement is drafted well.

Even though it is not binding, a prenup shows you both planned ahead and agreed. In a contested divorce, that can help in negotiations and in court.

Frequently asked questions

Will the court follow our prenuptial agreement?
Malaysian courts are not bound by a prenup. The court may treat it as one factor when it divides assets under Section 76, and a well-drafted one can be persuasive.
Should I still get a prenup?
It can be a useful record of each person's assets and intentions when you marry. It is not binding, but it can shape negotiations and the court's view. Get legal advice before signing.
Can a postnuptial agreement be enforced?
Like a prenup, an agreement made after marriage is not automatically binding. The court looks at it as part of the whole picture but can depart from its terms.
