Pahang is the largest state in Peninsular Malaysia, stretching from coastal Kuantan to Cameron Highlands. Civil divorce here follows the Law Reform (Marriage and Divorce) Act 1976, and petitions are usually filed at the High Court of Malaya at Kuantan.
Many families live far from the court. A lawyer who prepares well cuts out unnecessary travel and keeps the case moving.
What is a joint petition?
A joint petition divorce lets you file together when you both agree to end the marriage and have settled the key terms: children, money and property. It suits couples who can still talk things through.
In Pahang, joint petitions are heard at the Kuantan High Court and are often finished within three to six months of filing.
What if one spouse does not agree?
The other can file a contested divorce. You must prove the marriage has broken down through one of these facts:
- adultery
- unreasonable behaviour
- desertion for at least two years
- living apart for at least two years (your spouse’s consent is not needed)
Contested cases in Pahang follow the same steps as elsewhere: case management, mediation and trial preparation, all at the Kuantan court. Your lawyer takes you through each stage.
How is child custody decided?
Under Section 88 of the LRA 1976, child custody is decided on the child’s welfare. The court looks at each parent’s ability to care for the child, the child’s usual routine, and the child’s wishes if they are old enough.
Parents are encouraged to agree on custody before the hearing. The court usually approves an agreed plan, and children do better with that stability.
How far is the court?
Kuantan is the state capital and home to the High Court. Temerloh, in the centre of the state, is about two hours away by road. Bentong is roughly two and a half hours away, and the winding roads from Cameron Highlands take longer.
Most of the work, such as reviewing documents, negotiating and drafting, happens outside the courtroom. That limits the trips for families in distant districts.
