Contested divorce in Pahang

A divorce is contested when your spouse does not agree to the divorce or to its terms. You file a single petition on your own, your spouse responds, and the court decides what you cannot settle.

Many cases still settle before trial once both sides have seen the evidence.

Conciliation comes first

Under section 106 of Act 164, you usually have to try conciliation before you file, often at a marriage tribunal. You can file once the tribunal certifies that it could not reconcile you.

The court can then grant the divorce and also decide custody, maintenance and the division of property.

How long it takes

The conciliation body has up to six months to try to reconcile you. Court proceedings after that often take several more months, and longer if the case goes to trial.
