Spousal Maintenance (Alimony)

Spousal maintenance (sometimes called alimony) is money one spouse pays to support the other, during the divorce case or after it.

Under Sections 77 to 80 of Act 164, the court mainly looks at the means and needs of each spouse. A husband can be ordered to pay a wife. A wife can be ordered to pay a husband who cannot earn a living because of illness or injury.

Why it matters: if you depended on your spouse’s income, you may be able to ask for support.
