Child Maintenance

Child maintenance is money paid by one or both parents to cover a child’s upbringing after divorce, such as housing, food, clothing and education.

Under Section 92 of Act 164, each parent has a duty to maintain their children. This applies whether or not that parent has custody.

Why it matters: not having custody does not end a parent’s duty to pay. If the other parent will not contribute, the court can order maintenance and it can be enforced.
