Prenuptial Agreement

A prenuptial agreement is a contract a couple signs before marriage. It sets out how assets and money will be handled if they divorce.

Act 164 does not specifically provide for these agreements. Malaysian courts have treated them as one factor when dividing property, not as binding.

Why it matters: if you signed one, it may carry some weight, but the court still makes the final decision.
