EPF / KWSP
The Employees Provident Fund (EPF, or KWSP in Malay) is the compulsory retirement savings scheme for employees in Malaysia.
EPF savings built up during the marriage can be treated as matrimonial property. The court can divide them on divorce under Section 76 of Act 164, either by ordering part moved into the other spouse’s EPF account (sections 53A and 53B of the EPF Act 1991) or by balancing them against other assets.
Why it matters: EPF is often one of the largest assets a couple has, even if no one thinks of it as “property”. Check both spouses’ EPF statements when you list what is to be divided.
