Custody

Custody is the legal right to make major decisions about a child, such as schooling and medical treatment. Who the child lives with day to day is called care and control, and the court can give it to one parent separately.

Under Section 88 of Act 164, the court’s first concern is the welfare of the child. It also considers the wishes of each parent, and of the child if they are old enough to give an independent view.

Why it matters: the court does not decide custody by asking which parent deserves it. It asks what is best for the child, so that is what your case needs to show.
