Adultery

Adultery means your spouse had sex with someone else while married to you. Under Section 54(1)(a) of Act 164, it is one of the facts you can rely on to show the marriage has broken down.

You must prove two things:

  • your spouse committed adultery, and
  • you find it intolerable to live with your spouse.

Why it matters: adultery is used in a single petition, where one spouse files without the other’s agreement. You need evidence, so knowing what the court looks for helps you decide if this ground fits your case.
