Can you change your name after divorce?
Yes. Under the National Registration Act 1959, any Malaysian citizen can apply to change their name. You do not have to change it after divorce, but many people go back to their name before marriage.
You can also choose a completely new name. Some people keep their married name for work, or to match their children’s surname. The choice is yours.
How does it work at JPN?
- Visit your nearest Jabatan Pendaftaran Negara (JPN) branch and get the name change form.
- Fill it in and give a reason, such as going back to your maiden name after divorce.
- Submit it with your supporting documents.
- Once approved, JPN issues a new MyKad with your new name.
After that, you must update your name with every other body yourself: passport, driving licence, bank accounts and property titles. Each has its own process.
What documents do you need?
- your current MyKad and a photocopy
- your decree absolute (the final divorce order) as proof of divorce
- your original birth certificate, which shows your name before marriage
- a statutory declaration (a sworn written statement), if you are taking a completely new name
JPN may ask for more depending on your situation. Call ahead or check the JPN website so you only need one trip.
Can you change your children’s names?
This is a separate process. For a child under 18, both parents usually need to agree. If they do, you can apply at JPN together.
If the other parent does not agree, you may need to ask the court for permission. The court will consider whether the change is in the child’s best interests. This can take months and involves legal costs.
A child’s surname does not change just because the parents divorce. Many parents keep it the same for stability.
How long does everything take?
JPN processing times vary by branch. Updating your other records can take longer, as each agency and bank has its own timeline.
Make a list of every document and account in your old name. Start with your MyKad and passport, then use your new ID to update the rest.
