It is an agreement between you and your spouse that the court records, so it carries legal force. You decide the terms, not the judge.

The court still checks that the terms are proper, especially where children are involved.

Once recorded, everyone knows exactly what was agreed, and it can be enforced if someone does not follow it.

How does it fit into the divorce?

Under Section 52 of the Law Reform (Marriage and Divorce) Act 1976, a couple who both agree to divorce can file a joint petition. The terms you have agreed are filed with it.

If the court is satisfied with the arrangements, it records them. Those terms become the consent order that goes with your divorce.

This means no trial on issues you have already settled.

What does it usually cover?

  • custody and care of the children, and time with each parent
  • maintenance for the children and, where relevant, for a spouse
  • division of matrimonial property, such as the home, savings, vehicles and EPF
  • who pays which joint debts

Why does the wording matter?

A consent order is only as strong as its words. “We will share the children fairly” invites argument. A schedule with dates and handover details does not.

Amounts, deadlines and who does what should be exact. If property is to be transferred, say which property, to whom and by when.

Your lawyer can draft the terms so they can only mean one thing.

Is the agreement fair?

The court looks closely at terms about children, because their welfare comes first. Terms that shortchange a child may not be accepted as written.

Fairness between you also matters, especially if one of you agreed under pressure or without knowing the value of what was given up. Full disclosure of finances shows the deal was made with open eyes.

Separate legal advice for each spouse makes the agreement harder to challenge later.

How do you get one in place?

  1. Write down everything you have agreed on children, money and property, in plain words.
  2. Gather documents that show the value of assets and debts.
  3. Have a lawyer review and formalise the terms before they go to court.

Frequently asked questions

Is a consent order legally binding, or just a private agreement?
Once the court records your terms as a consent order, it has the same force as any order a judge makes after a trial. A private agreement the court never recorded is much weaker if your former spouse ignores it.
Can a consent order be changed after it is made?
Terms about children, such as custody and maintenance, can be reviewed if the child's welfare requires it. Terms dividing property are generally meant to be final. If things change, ask a lawyer whether a variation is possible.
What if my spouse breaks the consent order?
Because it is a court order, you can go straight to enforcement. The steps depend on what was breached, such as unpaid maintenance or a refusal to transfer property. Keep records and get advice on the right route.
