Lawyer fees

Lawyer fees are usually the biggest cost. For a simple joint petition, they are generally lower. This covers preparing documents, filing and appearing at the hearing.

A contested divorce costs more because of extra hearings and work. Disputes over custody, property or maintenance push it higher.

Under the Legal Profession Act 1976, lawyers must charge fair and reasonable fees. The Solicitors’ Remuneration Order 2023 sets fee scales for non-contentious work only, such as conveyancing, and does not set fees for divorce litigation, which are agreed between you and your lawyer. You can ask for a written fee estimate before you engage one.

Court and filing fees

Court filing fees are set by the court and are the same for everyone. They are small compared with lawyer fees.

Each extra application, such as for temporary custody or maintenance, has its own filing fee. After the divorce, you may also pay for certified copies of court orders.

Your lawyer should list these in the fee estimate.

Other possible costs

  • A property valuation, if property is involved. Ask a licensed valuer for a quote.
  • Stamp duty when property is transferred. Some divorce-related transfers may be exempt, so ask your lawyer.
  • Mediation fees, if you use a private mediator.
  • Financial experts, if there are complex assets such as a business or shares.

Not every divorce needs these, so your total depends on your situation.

Why a joint petition costs less

In a joint petition, you agree on the terms before filing. There is less legal work, fewer court appearances and it finishes sooner.

In a contested divorce, each side usually has its own lawyer, so there are two sets of fees. Hearings may stretch over months, and each one adds to the cost.

If you can agree on the main issues, a joint petition is the cheapest route. If you disagree at first, mediation may help you reach agreement.

The Legal Aid Department (Jabatan Bantuan Guaman) helps Malaysians who cannot afford a private lawyer. Your household income must be below the department’s limit.

It covers divorce, custody and maintenance. It is not completely free: you pay a small contribution based on your income.

To apply, bring your income documents and IC to the nearest office. If you are unsure whether you qualify, it is worth asking.
