Why your pass and your divorce are linked
If you live in Malaysia on a pass given because of your marriage, the two are tied. When the marriage ends, the reason for the pass ends too.
You do not have to leave the moment you separate. But your right to stay needs its own plan, made alongside the divorce, not after it.
If you start early, there is usually time to sort it out calmly.
What happens to a spouse or dependant pass
A pass held as the spouse or dependant of a Malaysian, or of a work-permit holder, depends on that relationship. After divorce, it may be shortened, not renewed or cancelled.
It does not always turn into another status by itself. You may need to apply for a different pass, such as one based on your own job, or leave and re-enter on another basis.
Ask the Immigration Department (Jabatan Imigresen) about your specific pass. Their rules and processing times decide what is realistic for you.
If your child is Malaysian
If your child is a Malaysian citizen, you may be able to apply to stay on that basis. It is not granted automatically.
You would usually need to make a fresh application and meet the department’s conditions. The custody and care arrangements for your child can matter to that application.
It helps to settle the child arrangements in the divorce and the immigration application together, so they support each other.
Filing for divorce in Malaysia as a foreigner
The Malaysian court can only hear your divorce if it has jurisdiction. This usually depends on your link to Malaysia, such as your domicile (the country you treat as your permanent home) or where you live.
These rules are technical, and a mistake can delay or derail a petition. Have a lawyer confirm that Malaysia is the right place to file before you start.
If you married overseas
A marriage registered in another country can generally still be ended in Malaysia, as long as it is recognised here and the court has jurisdiction.
You will usually need your marriage certificate, with an official translation if it is not in English or Malay. Keep it together with your passports and pass records.
Your rights to property and maintenance still apply
Your nationality does not remove your rights under the Law Reform (Marriage and Divorce) Act 1976. The court can still divide matrimonial property and order maintenance, whatever passport you hold.
Do not give up property or accept a settlement just to ease a visa worry quickly. Treat the pass and the money as two separate problems.
What to do now
- Gather your pass details, expiry dates, marriage certificate and your children’s documents.
- Note when your current pass runs out. That date sets your timeline.
- Get advice on the divorce and, at the same time, check your options directly with the Immigration Department.
