This is a general preparation checklist, not a valuation. Which EPF savings count as matrimonial assets, and how they are split, depends on the facts of your case and is decided by agreement or by the court. Confirm your own requirements with EPF and a lawyer.

How this works

Is EPF a matrimonial asset?

Generally, yes. Malaysian courts have treated EPF savings built up during the marriage as part of the assets that can be divided under Section 76 of the Law Reform (Marriage and Divorce) Act 1976. Contributions made before the marriage are usually treated differently.

There is no fixed percentage. The split depends on things like each person’s money and non-money contributions (including homemaking and childcare), how long the marriage lasted, and what you agree or the court decides.

Getting the paperwork right

EPF can only act once the split is written into a sealed court order or consent order that names the EPF account and the agreed division. An informal agreement between you is not enough.

Have a lawyer check this wording carefully. If it does not match what EPF needs, you can face delays even with a court order in hand.

What EPF asks for at the counter

EPF will generally want the sealed court order and certified copies of identity documents. EPF handles this through its own process, separate from the court, so plan for it as its own step.

Frequently asked questions

Is my spouse's EPF split automatically in a divorce?
No. EPF savings built up during the marriage are generally treated as matrimonial assets, but there is no automatic formula. The split is agreed or decided by the court, then written into the order.
When can I get the split done at EPF?
Only after you have a sealed court order or consent order that names the EPF account and the split. EPF acts on the court order, not on an informal agreement.
Do I need a lawyer to split EPF?
It is strongly advised. The order must be worded so EPF can act on it, and a lawyer can check this.
Is this tool free?
Yes. It gives general preparation guidance, not advice on your own accounts.
