How this works

What decides the cost?

The biggest factor is whether you file a joint petition or a contested (single) petition.

A joint petition under Section 52 of the Law Reform (Marriage and Divorce) Act 1976 usually costs less. You both agree on the terms, so there is less legal work and less court time.

What pushes the cost up?

  • disputes over custody, maintenance or property
  • valuations of a house, a business or EPF
  • more court hearings, applications and a full trial

If you disagree about matrimonial assets under Section 76, you may need valuers or accountants, which adds to the bill.

How do lawyers charge?

Most lawyers charge based on how complex the case is and the time it takes. Ask for the fee structure and a written estimate before you engage anyone.

Other costs to plan for

  • court filing fees
  • preparing documents
  • certified translations, if documents are not in Bahasa Malaysia or English
  • valuation reports
  • travel to court

If children are involved, the court may ask the Social Welfare Department (JKM) for a welfare report.

Frequently asked questions

How much does a divorce cost in Malaysia?
There is no fixed price. A joint petition usually costs less because you both agree on the terms. Disputes over custody, property or maintenance push the cost up, so ask any lawyer for a written fee estimate first.
What are the court filing fees?
Filing fees are set by the court and are small compared with legal fees. Extra fees may apply for other applications. The court registry or your lawyer can confirm the current fees.
Can I get legal aid for my divorce?
Possibly. The Legal Aid Department (Jabatan Bantuan Guaman) gives free or subsidised help to people under its income limit. The Malaysian Bar Council also runs legal aid centres.
