Who is this for?

If your marriage was registered under the Law Reform (Marriage and Divorce) Act 1976 (LRA 1976), you end it through a civil divorce, which covers non-Muslim marriages registered in Malaysia.

Where do Sibu cases go?

Sibu has its own registry of the High Court in Sabah and Sarawak, next to the town’s Sessions Court. Civil divorce is a High Court matter, so you may be able to file without travelling to another town.

The registry for a petition can depend on more than where you live. Check with a lawyer first. Your lawyer can then file for you and tell you when hearings are fixed.

What are your options?

If you both agree to end the marriage, a joint petition is usually the smoothest route. You file together, which saves time and eases the strain on the family.

If you cannot agree, a contested divorce lets one spouse file alone. They must prove the marriage has broken down, for example through unreasonable behaviour, desertion or living apart for at least two years.

How is child custody decided?

Child custody is always decided with the child’s welfare first. The court looks at the child’s age and emotional needs, each parent’s ability to care for them, and how stable the proposed home is.

If you agree on custody, the court will usually approve it. If not, the court decides on the evidence.

How a lawyer helps

A lawyer who knows the Sibu court can file your papers, speak for you at hearings and keep you updated.

Frequently asked questions

Which court handles civil divorce cases from Sibu?
Sibu has its own High Court registry, in the same complex as the town's Sessions Court. The right registry for a petition can depend on more than where you live, so confirm it with a lawyer before filing.
Do I need to travel outside Sibu to file for divorce?
Not necessarily. A lawyer can confirm whether your case is filed in Sibu or elsewhere, and handle most of the filing for you.
How long does a joint petition divorce take for Sibu residents?
It depends on court dates and whether your papers are complete. After the court grants a decree nisi (a provisional order), Section 61 of the Act says it becomes final after three months unless the court sets a shorter period.
