Which court handles PJ divorces?

Petaling Jaya does not have its own High Court. Civil divorce cases from PJ are usually filed and heard at the High Court of Malaya at Shah Alam.

The drive from most of PJ to Shah Alam takes about 20 to 40 minutes, depending on traffic.

Many PJ families prefer a lawyer with an office nearby. Your lawyer can then handle the filing and court appearances in Shah Alam for you.

Is a joint petition right for us?

If you and your spouse agree to divorce and can settle the main terms, a joint petition is usually the simpler route. You file together, so there is no need to prove fault.

You will need to agree on things like dividing property, maintenance (financial support) and who the children live with. A lawyer can help you both put these terms in writing before filing.

What if we cannot agree?

If your spouse will not agree to the divorce or disputes the terms, it becomes a contested divorce. This takes longer and can include case management, mediation and possibly a full trial at the Shah Alam High Court.

The spouse who files must prove the marriage has broken down, using one of the facts set out in the LRA 1976. A lawyer can tell you what evidence you will need.

How is child custody decided?

Child custody is decided on the child’s welfare, under Section 88 of the LRA 1976. The court looks at each parent’s ability to care for the child, the child’s routine and schooling, and the child’s own wishes if they are old enough.

Many PJ parents agree on custody through negotiation or mediation before any hearing. This usually means less conflict and an easier change for the children.

What should I prepare first?

  • Your marriage certificate
  • Copies of your MyKad or passport
  • Records of shared property and debts
  • Payslips and EPF statements
  • If you have children: their school, daily routine and current living arrangements

With these ready, your first meeting with a lawyer can focus on your options, not paperwork.

Frequently asked questions

Where do Petaling Jaya residents file for divorce?
Civil divorce cases from PJ are usually handled at the High Court of Malaya at Shah Alam, the Selangor state capital. The exact registry can depend on more than where you live, so check with your lawyer.
Can I hire a lawyer based in PJ even though the court is in Shah Alam?
Yes. A lawyer with an office in PJ can file your papers and attend court in Shah Alam for you.
What are the grounds for divorce under the LRA 1976?
If you file alone, you must show the marriage has broken down through adultery, unreasonable behaviour, desertion for at least two years, or living apart for at least two years. Your spouse's consent is not needed for the two-year separation. If you both agree, you can file a joint petition instead.
