Who uses the JB High Court?

Johor Bahru is the capital of Johor, at the southern tip of Peninsular Malaysia. Civil divorces from JB are usually heard at the High Court of Malaya at Johor Bahru, under the Law Reform (Marriage and Divorce) Act 1976.

Because JB is next to Singapore, many families here have cross-border issues: income earned in Singapore, property in both countries, or children schooling there.

Is a joint petition right for you?

A joint petition divorce works when you both agree on the divorce and its terms, including property, maintenance and custody. It is faster and less costly. After the decree nisi (first-stage order), there is normally a three-month wait before it becomes final.

If you can talk things through, a lawyer can turn what you agree into a proper legal document.

What if your spouse will not cooperate?

A contested divorce may be the only route. You must rely on one of these facts: adultery, unreasonable behaviour, desertion for at least two years, or living apart for at least two continuous years.

Contested cases at the JB High Court go through case management, sometimes mediation, and may end in a full hearing.

The Malaysian court deals with the divorce itself, but assets or income in Singapore may need extra steps. A lawyer can advise on showing overseas earnings and property abroad.

Child custody can also cross borders, for example if one parent plans to move to Singapore. The court’s first concern is the child’s welfare.

Getting to the court

The High Court of Malaya at Johor Bahru is on Jalan Dato Onn, reachable by car from the CIQ area, by bus from JB Sentral or by ride-hailing. Parking is available nearby. Arrive early, as there are security checks at the entrance.
