Void Marriage
A void marriage is treated as never having been valid. Under Section 69 of Act 164, a marriage is void if:
- either spouse was already legally married to someone still living
- a spouse was under 18 and the required special licence was not granted
- the spouses are too closely related (within the prohibited degrees), without a special licence
- the spouses are not male and female
Why it matters: a void marriage is ended by a decree of nullity, not a divorce, and this changes what you file.
