Affidavit
An affidavit is a written statement of facts that you swear or affirm is true. The court treats it as evidence.
In a divorce, affidavits are used to show facts such as:
- each person’s income and assets
- the children’s welfare
- how each spouse has behaved
Why it matters: much of a divorce case is decided on paper. What you put in your affidavit, and what you leave out, can shape the outcome, so it must be accurate and complete.
