Joint petition divorce in Labuan

If you both agree to divorce and on the main terms, a joint petition is usually the simplest and quickest route. You file together and nobody has to prove fault.

The court’s focus is whether your agreement is fair, not who is to blame.

What you need to agree on

Under section 52 of Act 164, the petition sets out what you have agreed about the children, maintenance and property. The court checks the arrangements are fair, especially for the children, before it grants the decree.

You do not need to go through conciliation first. Section 106 does not apply to joint petitions.

How long it takes

Most joint petitions are completed within three to six months. Court filing fees cover the petition, the affidavit and the statement about the children.

Lawyer fees are separate, so ask for a written estimate before you engage one.

Filing in Labuan

Joint petitions from Labuan are filed at the High Court in Sabah and Sarawak at Kota Kinabalu. Labuan (Federal Territory) is in East Malaysia, where the High Court in Sabah and Sarawak has its own rules and court lists.

Because the terms are agreed, hearings are usually short.
