Do you need a decree absolute first?
Yes. A divorce starts with a decree nisi, a first court order that is not yet final. Under Section 61 of the Law Reform (Marriage and Divorce) Act 1976, it becomes final when it is made absolute.
Under Section 62, you may marry again only after the decree absolute, once there is no appeal against it or the time to appeal has passed. A marriage made while the earlier one still exists is not valid.
The decree nisi cannot usually be made absolute until three months after it was granted, unless the court sets a shorter period. The spouse who obtained it applies; if they do not, the other spouse can apply later.
What documents do you need?
- Your decree absolute, which proves your earlier marriage has ended.
- Your MyKad and passport-sized photos.
- The standard marriage registration forms.
- If you are marrying a foreigner, extra documents such as a single status certificate from their country may be needed.
Keep the original decree absolute safe and use certified copies. If you have lost it, you can ask the court for a certified copy.
Where do you register?
Civil marriages are registered at the National Registration Department (JPN). Both of you give notice in person, and the notice is displayed so that anyone can object. The certificate for marriage can be issued only after 21 days from the notice.
The ceremony can take place at JPN or at a licensed place of worship. A marriage under the Act is monogamous: one husband, one wife.
If you are marrying abroad, check that country’s rules. Your decree absolute may need to be apostilled or notarised.
Updating your records
After the new marriage is registered, update your marital status at JPN. Also update your bank, employer, EPF (KWSP) and insurers.
Review your will too, as remarriage can affect how your estate is shared.
If you have children from the earlier marriage, remarriage does not change a custody order by itself. It may be considered if either parent applies to vary the order.
Maintenance after remarriage
Under Section 82, a former spouse’s right to receive maintenance ends when they remarry. If you are the one paying, your own remarriage does not end your duty to pay.
Child maintenance continues whoever remarries. It depends on being a parent, not on marital status. If your new household adds children, the court may consider your overall commitments in a later variation application.
Read your existing court orders before you remarry so you know what continues and what may change.
What to do now
Check that your decree absolute has been granted. If you only have a decree nisi, ask the court or your lawyer about making it absolute. Without it, you cannot legally remarry.
If property, maintenance or custody issues from the divorce are still open, settle them before you remarry. Our remarriage guide covers what changes.
