Warning signs

Some behaviour suggests a spouse may be hiding assets:

  • reported income suddenly drops
  • unexplained transfers to family members
  • new trusts set up just before the divorce
  • overpaying tax or creditors so refunds can be collected later
  • large cash withdrawals, luxury purchases or secrecy about money

Watch for a lifestyle that does not match the income claimed. A spouse who says they earn little but lives well may have income they are not declaring.

The duty to disclose

Both spouses must give full and honest details of their finances. This is part of the financial disclosure process in a Malaysian divorce.

Each spouse files an affidavit of means (a sworn statement) listing assets, debts, income and expenses. If their finances change during the case, they must update it.

What the court can do

The strongest tool is an adverse inference. The court can assume undisclosed assets exist and give them a value that works against the spouse who hid them.

The court can also order specific discovery, forcing the spouse to hand over documents such as bank statements, tax returns and company records. If they refuse, the court can make further orders, including for contempt.

How to trace hidden assets

Start with the documents you can already see. Bank statements, tax returns and property records may show transfers to unfamiliar accounts, payments to unknown people, or assets that have vanished.

Your lawyer can apply for subpoenas (court orders to produce records) from banks, companies and government agencies. These records are valuable because your spouse cannot alter them.

A forensic accountant can follow the money. They can spot transfers through several accounts, undervalued business assets and manipulated company accounts.

Assets held overseas

Overseas bank accounts, property abroad and shares in foreign companies are easier to hide. But the court’s powers cover assets wherever they are.

Your lawyer can seek disclosure orders that cover overseas assets. The key is knowing which countries are involved and what legal tools each one offers.

What happens to a spouse who hides assets

If hidden assets come to light after the divorce, the court can reopen the financial settlement. The spouse who hid them may also get a smaller share of what remains.

In serious cases, hiding assets can amount to fraud or contempt of court, and criminal penalties may apply.

Frequently asked questions

What happens if my spouse lies about their assets?
The court treats this seriously. It can draw an adverse inference, meaning it may assume the hidden assets exist and are worth a lot. The spouse may also face contempt of court proceedings.
Can I hire a private investigator to find hidden assets?
Yes, but the evidence must be obtained lawfully. Your lawyer can advise which methods are acceptable and how to put the findings before the court.
How long does it take to trace hidden assets?
It depends on the case. Assets in local bank accounts are quicker to trace than offshore accounts, several companies or trusts, which can take months.
