Are court fees the same across Malaysia?
Yes. Court fees are set nationally under the Courts of Judicature Act 1964 and the Subordinate Courts Rules. Filing in Kuala Lumpur, Penang, Johor Bahru or Kota Kinabalu costs the same.
The same goes for fees for affidavits, hearings and certified copies. So the difference in total cost between states comes almost entirely from lawyer fees.
KL and Selangor
Lawyer fees for divorce work are highest in Kuala Lumpur and Selangor. Running a firm in the Klang Valley costs more, and so does living there.
Even a joint petition (where you both agree) tends to cost more here. A contested divorce costs much more, and cases with complex assets more again.
Ask any lawyer you approach for a written fee estimate.
Penang and Johor
Penang and Johor Bahru sit in the middle. Both have experienced family lawyers, but running a practice costs less than in KL.
Some firms in Johor Bahru deal with cross-border family matters, for example Malaysians who live or work in Singapore.
Other Peninsular states
In states such as Perak, Negeri Sembilan, Melaka, Kedah and Kelantan, lawyer fees tend to be lower than in the big cities.
There may be fewer lawyers who focus on family law there. In smaller towns, general practice lawyers often handle divorces alongside other work.
If your case involves high-value assets, a business or an overseas element, a lawyer in a larger city may be worth the extra fees and travel.
Sabah and Sarawak
Lawyer fees in Sabah and Sarawak are generally lower than in Peninsular Malaysia.
Land law there comes under different legislation, which can affect how property is divided. Civil marriages are still dealt with under the Law Reform (Marriage and Divorce) Act 1976.
Courts in East Malaysia cover large areas. If you live far from a High Court, travel for hearings adds to the cost.
Should location decide your lawyer?
Cost should not be the only factor. Also look at experience in family law, how clearly the lawyer explains things and whether you feel comfortable with them.
For a simple joint petition, a competent lawyer in any state can do the work. If your case will be heard in a particular court, a lawyer who appears there often knows its procedures.
It can help to speak to two or three lawyers before you decide, and compare their estimates and approach.
